U.S. Tariff Litigation Returns to Trade Court, Tax Refund Process May Accelerate

On March 2nd, local time, an American appellate court remanded several lawsuits that previously invalidated President Trump’s large-scale tariffs back to the U.S. International Trade Court. The U.S. International Trade Court has the authority to decide on the refund of relevant taxes paid by importers. Previously, importers requested the Trade Court, once the case was under its jurisdiction again, to order the Trump administration to immediately begin the refund process.

The U.S. Federal Circuit Court of Appeals approved the importers’ motion to remand the case to the U.S. International Trade Court. The Trump administration opposed this motion, stating that they hoped to delay the case by up to four months to consider response options.

On February 20th, the U.S. Supreme Court ruled that the large-scale tariffs imposed under the International Emergency Economic Powers Act by Trump were invalid. Over 300,000 importers paid these tariffs, but the Supreme Court did not provide guidance on how the government should refund these funds. Trump previously stated that the refund process could trigger legal disputes lasting up to five years.

Currently, about 2,000 importers have filed lawsuits demanding refunds, many of which are large multinational companies such as FedEx.
