On March 11th local time, U.S. Trade Representative Katherine Tai announced that the United States will initiate Section 301 investigations against 16 trading partners, including China, the European Union, Mexico, Vietnam, India, and Japan.

The so-called “Section 301 investigation” originates from Section 301 of the U.S. Trade Act of 1974. This provision authorizes the U.S. Trade Representative to investigate “unreasonable or unfair trade practices” of other countries and to recommend unilateral sanctions to the U.S. President after the investigation concludes. This investigation is initiated, conducted, adjudicated, and enforced by the United States itself, reflecting a strong unilateralist approach.
